Online Fitness Class Waiver and Release of Liability
Preamble and Acknowledgment
I. Acknowledgement of Risk
I, the undersigned participant, acknowledge that I have voluntarily chosen to participate in online fitness classes (the “Classes”) offered by JustFit LLC.
I understand that physical exercise, especially strenuous activity like fitness classes, is a potentially hazardous activity. I recognize and understand that the Classes involve risks, including, but not limited to:
- Risk of injury, illness, or death.
- Risk of damage to personal property.
- Risks inherent in performing physical exercises without in-person supervision and proper form correction.
- Risks associated with the use of my own equipment, facilities, and workout area, including but not limited to, poorly maintained equipment, slippery surfaces, or obstructions.
- Risks associated with technical issues, such as poor internet connectivity, video or audio failures, or equipment malfunction, which may prevent the Instructor from monitoring me effectively or me from following instructions.
I voluntarily assume all risks, known and unknown, associated with my participation in the Classes, even if arising from the negligence of the Instructor/Company or others, and assume full responsibility for my participation.
Health and Medical Disclosure
II. Health and Medical Condition
I certify that I am physically fit and have not been advised by a qualified medical professional to avoid physical exercise. I understand it is my responsibility to consult with a physician prior to and regarding my participation in the Classes.
I affirm that:
- I have no medical condition that would prevent me from safely participating in the Classes.
- I will immediately notify the Instructor if I experience any pain, discomfort, or injury during a Class and will discontinue the exercise immediately.
- I will inform the Instructor of any changes to my physical or mental health status that may affect my ability to participate safely.
Waiver and Release of Liability
III. Release and Indemnification
In consideration of being permitted to participate in the Classes, I, the undersigned, on behalf of myself, my heirs, personal representatives, and assigns, hereby WAIVE, RELEASE, AND FOREVER DISCHARGE JustFit LLC, and its instructors, employees, agents, representatives, and successors (collectively, the “Released Parties”), from any and all claims, demands, losses, or liabilities, arising out of or related to my participation in the Classes, including but not limited to:
- Injury, illness, or death.
- Any claims of negligence or fault of the Released Parties.
- Loss or damage to personal property.
I further agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any loss, liability, damage, or cost they may incur due to my participation in the Classes, whether caused by the negligence of the Released Parties or otherwise.
Online Class Specific Provisions
IV. Online Class Rules and Understanding
I understand and agree to the following conditions specific to online classes:
- I am responsible for finding a suitable, clear, and safe physical space for the workout.
- I am responsible for the proper maintenance and safe use of any equipment I choose to use during the Classes.
- I must listen carefully to all instructions and modify or stop any exercise that feels unsafe or uncomfortable.
- The Instructor is not able to provide the same degree of in-person supervision and form correction as in an in-person setting. My safety is ultimately my own responsibility.
- I agree not to record, reproduce, or redistribute the content of the Classes without the express written consent of the Instructor/Company.
Binding Effect
V. Agreement
I confirm that I am 18 years of age or older.
I have had sufficient opportunity to read this entire document. I understand its terms and that I am giving up substantial rights, including my right to sue. I knowingly and voluntarily agree to be bound by its terms.
